✒ Detailed guide to filing a complaint against a police officer

The list of laws and instructions that regulate the work of the police is quite extensive - federal laws, Presidential Decrees, Orders of the Ministry of Internal Affairs, Administrative Regulations.

Ordinary citizens should also familiarize themselves with some regulatory documents if there is a need to appeal against the actions or inactions of police officers.

These include:

  • Federal Law No. 3 of 02/07/2011 “On the Police” (Article 53);
  • Order of the Ministry of Internal Affairs of the Russian Federation No. 1138 of December 24, 2008 “On the Code of Professional Ethics”;
  • Federal Law No. 342 of November 30, 2011 “On service in the internal affairs bodies of the Russian Federation” (Article 49);
  • Art. 286 of the Criminal Code of the Russian Federation “On abuse of official powers”.

Grounds for filing a complaint

There are two types of complaints against the activities of police officers - illegal actions and inaction.

The first include:

  • refusal to introduce yourself and present documents;
  • rudeness, profanity, insults, rudeness;
  • a response to the citizen’s application has not been provided, the employee avoids interacting with the citizen;
  • use of physical force without justification;
  • extortion;
  • search or personal search without authorization;
  • disclosure of private life facts;
  • there are no legal grounds for checking documents;
  • the police officer is under the influence of alcohol or drugs;
  • the employee clearly acts in the interests of persons associated with him (relatives, in-laws, colleagues);
  • abuse of power;
  • interviewing minors without the involvement of legal representatives, the prosecutor's office or guardianship authorities;
  • exceeding the terms of detention;
  • beatings;
  • concealing evidence or the fact of a crime, providing assistance to the person who committed the offense;
  • exerting psychological, moral, physical pressure, threats against a detainee, victim, etc.

Inaction by police officers includes:

  • refusal to accept and register a statement about a crime or offense committed, as well as failure to respond to a message about an impending crime;
  • an inspection is not carried out at the request of a citizen;
  • the initiation of a criminal case was refused, while the inspection was carried out negligently;
  • incorrect classification of an act in order to refuse to initiate a criminal case;
  • the policeman refuses to stop the crime, to stand up for the protection of citizens, law and order;
  • The police officer ignores complaints, statements, and appeals from citizens.
