Free government lawyers will receive the right to a “lawyer request”

Amendments to the law “On Free Legal Aid in the Russian Federation” were approved, obliging authorities and other organizations to provide information to state legal bureaus that provide citizens with free legal assistance. Responses to requests from the law office will need to be provided within 30 days and without fail, in complex cases - within up to 60 days. An unlawful refusal to provide information at the request of a law office will fall under Art. 5.39 Code of Administrative Offences. According to the Ministry of Justice, state legal bureaus have already been created in 25 constituent entities of the Russian Federation.

Opportunities for online participation in meetings are expanding

The norms for making decisions at meetings of civil law communities are changing. Changes to Part 1 of the Civil Code of the Russian Federation will allow meetings to be held remotely - using electronic or other technical means that make it possible to reliably identify the person participating in the meeting and give him the opportunity to participate in the discussion. Remote participation will require mandatory compliance with two conditions: reliable authentication and the properly expressed will of the participants. Amendments to the law on the Investigative Committee, which relate to issues of service, were approved. Among other things, the list of grounds for dismissing investigators is being expanded. An ICR employee in the reserve will be fired for refusing to be appointed to a proposed vacant position. In addition, any ICR employee will also be fired for absence from service for more than four months a year due to temporary disability. An exception is made for occupational diseases or other health injuries associated with the performance of official duties.  

The “narcotics” article will be partially decriminalized

A note is added to Article 228.2 of the Criminal Code of the Russian Federation (violation of the rules for the circulation of narcotic drugs or psychotropic substances), according to which its norms do not apply to persons, including employees of medical organizations, who have allowed the loss of drugs, when such loss is not related to their deliberate introduction into illegal circulation . In this case, the fact of loss must be recorded in accordance with the commission procedure established by the Ministry of Health of Russia in agreement with the Ministry of Internal Affairs of Russia. The amendment does not exclude disciplinary and financial liability for the loss of entrusted narcotic drugs and psychotropic substances, explained the Ministry of Internal Affairs, where the bill was developed.

Defamation is now punishable by imprisonment

Law No. 538-FZ dated December 30, 2020 amended Article 128.1 of the Criminal Code of the Russian Federation:

  • Part 2 was supplemented by a new way of disseminating false defamatory information - through information and telecommunication networks, including the Internet. The sanction of the unit has also changed - in the previous version, the maximum that threatened the perpetrator was 240 hours of correctional labor, whereas today the punishment is much more severe - up to 2 years in prison;
  • up to 4 years of imprisonment can now be received for disseminating false information about a dangerous disease. Previously, the upper limit of punishment was softer - 400 hours of compulsory work;
  • slander associated with an accusation of a crime against sexual freedom and sexual inviolability has moved from part 4 of article 128.1 of the Criminal Code of the Russian Federation to part 5, which is now shared with slander associated with an accusation of a serious or especially serious crime. The culprit faces up to 5 years in prison.

Liability for hooliganism has been tightened

Law No. 543-FZ dated December 30, 2020 amended Article 213 of the Criminal Code of the Russian Federation:

  • liability has been established for hooliganism with the use or threat of violence against citizens. Such a crime is now qualified under paragraph “a” of Part 1 of Art. 213 of the Criminal Code of the Russian Federation. The previous version of this paragraph provided for hooliganism with the use of weapons;
  • armed hooliganism “moved” to Part 2 of the article. If earlier he faced a maximum of 5 years in prison, now - up to 7 years.

Criminal liability has been introduced for violating the legislation on foreign agents

Law No. 525-FZ of December 30, 2021 almost completely changed Article 330.1 of the Criminal Code of the Russian Federation. The amendments even affected the name of the norm:

The article has been supplemented with Part 2, which provides for liability for violating the rules of operation of a foreign media outlet recognized as a foreign agent.

The same part punishes the failure of another person included in the register of foreign agents to fulfill the duties assigned to him, but in this case, administrative prejudice is provided as a prerequisite for bringing to criminal liability. That is, the person must be subject to administrative punishment under Part 2 of Art. 19.34.1 Code of Administrative Offenses of the Russian Federation.

Rich Russians will be allowed to create personal funds

Amendments are being made to parts 1 and 3 of the Civil Code of the Russian Federation, which complete the 20-year process of reforming domestic inheritance law, during which the number of inheritance lines was increased to eight, targeted amendments were made on certain issues, and new types of orders were introduced in the event of death, in including hereditary (“posthumous”) funds. The adopted law provides for the possibility of creating not only hereditary (“posthumous”) funds, but also “lifetime” personal funds, created and operating during the life of the founder and continuing to exist after his death. According to the author of the law, head of the legislative committee of the State Duma Pavel Krasheninnikov, the advantage of such funds is that the founder can himself control the process of creating the fund, regulate its activities and minimize possible risks.

New qualifying signs of inclination to drug use have appeared

Law No. 25-FZ dated February 24, 2021 supplemented Art. 230 of the Criminal Code of the Russian Federation with new aggravating circumstances:

  • in Part 2, paragraph “d” appeared, establishing liability for inducing drug use via the Internet;
  • The article has been supplemented with part 4 – inducement to use drugs, resulting in the death of two or more victims through negligence. The maximum penalty is 15 years in prison.
