How to get into the economic detachment and remain to serve time in a pre-trial detention center

After the court's conviction has entered into force, the convicted person is subject to mandatory transfer from the pre-trial detention center to a correctional colony. But there are exceptions to this rule. One of them is the housekeeping unit in the pre-trial detention center. In accordance with Art. 74 of the Criminal Executive Code of the Russian Federation (hereinafter referred to as the Penal Code of the Russian Federation), pre-trial detention centers can perform the functions of correctional institutions in relation to convicts who are left in the pre-trial detention center to perform economic work on the territory of the detention center.

According to Art. 22 of the Law of the Russian Federation of July 21, 1993 No. 5473-1 “On institutions and bodies executing criminal punishment in the form of imprisonment”, convicts can also be involved in the economic maintenance of pre-trial detention centers.

Household work on the territory of pre-trial detention centers includes the following activities: cooking; cleaning of territories; ironing; other auxiliary work that is required for the normal functioning of the insulator.

What are the advantages of convicts from the economic detachment in a pre-trial detention center compared to staying in a colony?

  • Detention centers are usually located in large cities or regional centers, while correctional colonies are most often located in remote areas. Therefore, when serving a sentence in a pre-trial detention center, it may be easier to receive parcels and provide visits with relatives (of course, under certain conditions).
  • In accordance with Part 3 of Art. 77 of the Penal Code of the Russian Federation, convicts working in the economic unit of a pre-trial detention center are kept separately from other prisoners in unlocked cells. At the same time, they are given a regime identical to the lighter conditions in general regime colonies, with the right to a daily walk lasting 2 hours.
  • For persons held in pre-trial detention centers, increased standards of clothing allowance have been established compared to correctional colonies.
