Is it possible to have sex at 16? There are several opinions on this matter. Caring parents and the older generation, for whose representatives sex before marriage was a shame, of course, try to keep teenagers from early sexual experience with all their might. Horror stories about sexually transmitted diseases, teenage pregnancy and even bullying are used. But statistics say that by the age of 14, every tenth child loses their virginity. Therefore, the issue of sexuality in adolescence is worth considering in more detail.
What is the age of consent?
Is it legal to have sex at 16? In criminal law, there is such a thing as the “age of consent”, that is, the age at which a person is considered capable of giving informed consent to sexual relations with another person. In most countries, the age of consent is set between 14 and 16 years, but this concept may not be included in the law at all or may be as high as 20 years.
In Russia, the age of sexual consent is 16 years old, that is, from this moment a person can legally enter into sexual relations. Voluntary relationships between persons under the age of majority are not punishable. It is interesting that in Yemen, for example, the age of consent is only 9 years old, in Mexico, the Philippines and Angola - 12 years old, in Italy, Germany, China, Hungary, Brazil - 14 years old, in Egypt, Iraq, Malta, Turkey – 18 years old.
Latest changes in legislation
Since 2013, sexual relations with a minor between the ages of 16 and 18 may be subject to criminal prosecution if it is proven that the teenager is involved in sexual relations for the provision of related services.
If it is established that the victim expressed consent on the basis of receiving any reward (monetary or other nature, as well as due to the promise of reward to another person), the actions of the perpetrator, who has reached the age of 18, will be qualified under Art. 240.1 of the Criminal Code of the Russian Federation.
First time: when?
Already at the age of 13, a child has an understanding of what sex is. Some girls begin to have sexual intercourse with older boys already at this age, but boys liberate themselves a little later - at about 15 years old. But neither 13 nor 15 years old is a suitable age for the first sexual contact.
There are several well-founded explanations for this. The female body, in theory, is already ready to bear a child, but this does not mean that the girl is ready for sexual activity. Full maturation of the body occurs on average at 18 years of age. But you shouldn't lose your virginity too late either. At about 25 years, the hymen turns from a thin septum into a fairly dense tissue, so that the process of its rupture will be quite difficult and painful. Attention should be paid to the psychological maturation of both partners. Unpleasant consequences can only be avoided if each partner is ready for sexual intercourse.
Is it possible to have sex at 16? Theoretically and legally it is possible, but in practice many girls postpone their first sexual experience until later in life. In fact, there are no clear criteria or boundaries here. The first sex should happen when both partners are ready for it, informed about the possible risks and means of contraception. What is important is the girl’s personal desire and confidence in her feelings for the young man. You need to try to honestly answer the question of whether this is the person with whom you would like to have your first sexual experience. If the answer is yes, then you can move on to the next point.
Suitable age for first sex
In tribal societies, and later in ancient cultures, the appropriate age for sex was determined quite simply - if a girl got her period and a boy grew pubic hair, then they were old enough for sex.
This usually happened at the age of 12–14, but the framework was quite conditional. In ancient Greece, the age of 12–14 years was acceptable in both heterosexual and homosexual relationships. However, everyone had the right to their opinion. The ancient Greek poet Hesiod wrote in his poem “Works and Days” that a wife should ideally be chosen among girls who went through puberty five years ago (that is, among 17-19 year olds).
Only in the 1st century did marriage become a state matter, and Gaius Julius Caesar made it a two-stage process: first, the heads of families entered into an agreement for the marriage of their children, and then the marriage took place. It was from Rome that the tradition of marriage agreements spread throughout the world. In Islamic countries, for example, a future wedding was agreed upon before children reached puberty, when they were about seven years old, but teenagers got married after the girl started menstruating.
In the middle of the 12th century, the monk Gratian from the strict medieval order of Camaldoli wrote the book Decretum (in Russia, historians know it as “The Harmonization of Dissenting Canons”). In his work, Gratian tried to bring texts from different authoritative sources to some kind of unity, removing contradictions. It remains in history as the first work on law after the ancient Roman era - the starting point of modern jurisprudence.
In his work, Gratian also touched on the appropriate age for marriage (and, accordingly, sex) - according to traditional ideas, he wrote that entering into a marriage should be approximately between 12 and 14 years. However, he added, the consent and expression of the will of the future spouses also matters, and if it exists, then marriage vows can be exchanged starting from the age of seven. It was these postulates of Gratian that formed the basis of European legislation for a long time.
How to prepare for first sex?
Is it possible to have sex at 16? Yes, if both partners are ready for this, understand all the dangers and risks associated with early sexual activity, trust each other and are able to hear and understand each other. Few young people, on the eve of such an important event as their first sexual experience, turn to their parents for advice, but in vain. It’s not worth listening to friends and acquaintances of the same age, because everyone has different experience, knowledge and relationship characteristics.
Girls who are very nervous about whether they can have sex at 16 years old should be advised to postpone their first experience until another time. If you have minor doubts, you can prepare for the first sex: read special literature, find out what the missionary position looks like - the best option for deflowering, take care of hair removal and beautiful lingerie. You can drink a glass of wine, but no more.
Is it possible to avoid liability if you marry the injured person?
According to the note to Art. 134 of the Criminal Code of the Russian Federation only a person who has committed a crime for the first time under Part 1 of Art. 134 of the Criminal Code of the Russian Federation (i.e. for sexual intercourse with a person who has reached 14 years of age, but has not reached 16 years of age), is exempted by the court from punishment if it is established that this person and the crime he committed have ceased to be socially dangerous due to marriage with the victim(s). In judicial practice, there are cases of exemption from punishment on this basis. When considering these cases, the circumstance of marriage with the defendant is considered as significantly reducing the danger of the subject of the crime and the crime he committed. The court recognizes that it ceases to be socially dangerous in connection with marriage (see Judgment of the Konstantinovsky District Court of the Amur Region dated July 16, 2010 in case No. 1-96/2010). On the same basis, the defendant, who was charged with torturing the victim and under Part 1 of Art. 134 of the Criminal Code of the Russian Federation. He admitted his guilt, paternity of his young daughter, and entered into marriage with the victim (see Determination of the judicial panel for criminal cases of the Sverdlovsk Regional Court dated July 16, 2010 No. 22-7175/2010).
The most common fear
Almost every girl before the first intimacy is worried about the pain of penetration. Here a lot depends on the behavior of the girl herself and her partner, as well as on physiological characteristics. The pain when the hymen ruptures can be quite insignificant, and it can be tolerated if the first sexual intercourse is with a loved one. It is advisable to acquire a lubricant to make penetration of the penis easier and more pleasant; you should also not squeeze the vaginal muscles, because for painless sexual intercourse the girl must be relaxed.
Loss of blood during the first sexual intercourse is completely optional. There may be no blood at all, and if there is, it will not cause any unpleasant sensations or discomfort. It often happens that such discharge may appear during the second sexual intercourse. It is advisable to take a break of three to five days between the first and second times to allow any tears in the vagina to heal.
Rights and responsibilities of a child from 14 years of age
A citizen who has reached the age of 14 receives a passport, and with it a list of new rights and responsibilities. For example, for the first time a child gets the opportunity at the official level, without the participation of parents or guardians, to apply to the courts to protect their interests, and also gains the right to personal income, which they can dispose of as they wish, including investing money in banks and other financial institutions.
A teenager receives protection of his rights from the guardianship authorities if any conditions for his full physical and moral development are negligently fulfilled or maliciously violated, or from the judicial system if an administrative or criminal violation has been committed against the teenager. The second option can only be implemented with the participation of the child’s parents or official guardians.
Also, at the age of 14 you can get your first driver’s license, but with restrictions - only categories A and A1.
The teenager's voice now matters when choosing citizenship - it can now be abandoned completely if there is an alternative in another country.
From the age of 14, the Family Code begins to take into account the opinion of a teenager in divorce and guardianship proceedings. For example, he can choose his guardian (by mutual consent), refuse adoption or establish paternity.
Independent choice of place of residence is carried out, but only with the consent of the parents or other persons responsible for the teenager.
A child has every right to a private life, and interference in it even by parents or psychologists is justified only by a situation that is dangerous to the life and health of the child or other people.
Housing for a 14-year-old teenager is provided by a parent, guardian or government organization if the child is left without guardianship. There must be an official registration at the place of residence of one of the parents.
Criminal liability
A child under 14 is not responsible for his actions, including those of a violent nature - his parents are fully responsible for him, but upon reaching this age, the laws of the Criminal Code of the Russian Federation can be applied to a citizen. Of course, young age is taken into account when assigning punishment in the form of fines or imprisonment.
Employment
From the age of 14, a citizen has every right to get a job, open a work book, and officially receive wages and vacation days for his work.
The full use of child labor (full time in the Russian Federation) is illegal. A 14-year-old teenager cannot get a full-time job, only 24 hours a week.
This measure was taken by law in order to preserve the health of children who are not yet fully aware of their actions.
All other responsibilities, namely: fulfilling all the employer’s requirements on an equal basis with adult workers, complying with the established regulated work schedule and other requirements specific to each type of work fall on the teenager in full.
Have you ever encountered violations of the rights of children - your own or others?
Unfortunately, happened Did not happen There is not enough knowledge to understand whether rights were violated or not
Is it possible to get pregnant
Is it possible to have sex at 16? There are a huge number of pros and cons, but one of the most common fears of both girls and young men is the fear of an unplanned pregnancy. In adolescence, this can turn into a real tragedy. The first time is not an obstacle to successful fertilization, so you definitely need to make sure that sex is “protected.”
A condom provides approximately 85% protection against unwanted pregnancy, birth control pills provide up to 99%, and interrupted coitus provides only 60% protection. Moreover, only a condom as a means of barrier contraception also protects partners from STDs. If a couple chooses oral contraceptives, that is, pills, you need to know that only a gynecologist should prescribe them.
Is it possible to have sex at 16 years old while on your period? On critical days, sexual intercourse will reduce pain and, possibly, shorten the duration of menstruation. But at the same time, the likelihood of transmitting infection from one partner to another increases. It is important that menstruation does not protect against pregnancy. In addition, you should not make love if you have heavy periods or pain in the lower abdomen. Intimacy during menstrual periods also requires more careful adherence to personal hygiene rules.
Desirable conditions for first sex
Due to inconvenience, fear or embarrassment, partners may experience discomfort, which provokes muscular tightness, making the young girl unable to achieve orgasm. In such cases, turning off the light (if intimacy takes place in the dark) or a scarf slightly covering the eyes helps. Mandatory conditions are:
- mutual consent of partners;
- availability of a comfortable bed;
- complete privacy;
- use of contraceptives.
The best remedy is a condom. It is lubricated, completely ready for use, and allows the penis to penetrate the vagina more easily. Available at any pharmacy, sold without a prescription, does not require prior medical consultation and has no contraindications (except for the presence of a severe allergy to latex products).
When washing after sex, you should give preference to special age-appropriate products, since there are separate preparations for both 14-year-olds and 40-year-olds. At best, let it be plain water, but not shampoos, gels or hand soap, as they can cause irritation and itching due to the difference in alkaline balance.
Precautionary measures
- If your period started quite early and you are drawn to sex, the risk of pregnancy cannot be ruled out, so protection during contact will not be superfluous. The most reliable means is a condom. It will protect against infections, sexual diseases and unwanted pregnancy.
- At the time of the first sexual intercourse, severe pain may be noted if the girl is nervous and very tense. Therefore, you should not start sex if there is not enough arousal, and this is signaled by vaginal discharge - natural lubrication. If there is a deficiency, it is recommended to use a special lubricant available at a regular pharmacy. The fear factor can also affect tension.
- Another caution concerns personal hygiene. It is advisable to wash yourself before contact, as well as after it. This will prevent external microflora (from the labia) from entering the vagina.
- If pain occurs, the girl does not need to distance herself from her partner. On the contrary, she should lean forward, meeting him halfway. This reduces the time of psychological stress and painful sensations.
The Dangers of Teen Sex
Many young people are not sufficiently aware of all the dangers of teenage sex. This is not only an unwanted pregnancy with all the ensuing consequences. Sexually transmitted diseases are possible, especially if one of the partners has already had sexual experience and did not bother to take care of contraception. Early sexual experience, if partners are not psychologically ready for it, can cause further fear of relationships and the opposite sex, dissatisfaction with sex and other psychological problems.
